As of December 30, 2024, contractors and subcontractors submitting bids or performing construction work on projects covered by Article 8 of the New York State Labor Law are required to register with the New York State Department of Labor before submitting any bids or beginning any work.
New York State Labor Law 220-I sets forth the minimum required information that contractors and subcontractors must provide to the NYSDOL, along with an application fee. Unless the contractor or subcontractor is determined to be unfit to be registered, they will be issued a certificate of registration.
Our municipal and school district clients must require that all contractors and subcontractors who submit bids and perform work on any projects on their behalf, submit their certificate of registration along with their bid submissions and certainly prior to awarding any public contracts. Should a contractor or subcontractor fail to have a certificate of registration, the bid must be considered unresponsive and be rejected.
